Special counsel Jack Smith filed a Notice of Appeal Earlier this week, federal Judge Aileen Cannon in a Florida court ruled to dismiss a case against former President Donald Trump in a criminally classified document.
Smith’s appeal, as expected, will be heard in court United States Court of Appeals for the Eleventh Circuit Based in Atlanta, it reviews cases before federal courts in Florida.
Cannon on Monday dismissed the case against Trump and two co-defendants, ruling that appointing Smith to prosecute cases involving the former president violated the Appointments Clause of the U.S. Constitution.
Trump is accused in the case of keeping classified government documents at his Mar-a-Lago club residence after leaving the White House in January 2021 and trying to conceal them from government officials seeking to return.
“At this time, we have no comment beyond the document itself,” Peter Carr, a spokesman for Smith, said Wednesday.
Carr said Monday that Cannon’s decision to dismiss the case “deviates from the unified conclusion of all parties.”
Previous courts have considered the issue of the Attorney General’s authority to appoint special prosecutors.
