On Monday, a federal judge in Florida fired The case against former President Donald Trump in a classified criminal documents case says the appointment of special counsel Jack Smith as prosecutor in the case violated the Appointments Clause of the U.S. Constitution.
Trump is accused of illegally retaining classified government documents after leaving the White House in January 2021 and attempting to withhold them from government officials seeking their return.
Judge Aileen Cannon was appointed to the federal bench by Trump.

Smith’s office can appeal Cannon’s ruling. The issue will likely end up before the U.S. Supreme Court.
Trump still faces three other pending criminal indictments. In one, in federal court in Washington, D.C., the Republican was charged with crimes related to his efforts to overturn his 2020 election loss to President Joe Biden.

Trump has been charged with racketeering in a state case in Georgia related to his attempt to overturn his 2020 election loss.
He was convicted this year of crimes related to hush money payments made by his then-lawyers to porn star Stormy Daniels and is awaiting criminal sentencing in New York state court.
