A federal judge in Washington, D.C., ordered former Trump White House aide Steve Bannon to report to prison by July 1 to begin serving his four-month prison sentence during a hearing Thursday. contempt of parliament conviction.
Judge Carl Nichols issued the order three weeks ago after federal prosecutors urged him to revoke Bannon’s probation pending his failure to comply with a House committee investigating the Jan. 6, 2021, Capitol riot. Appeal from conviction issued by summons.
A federal appeals court jury unanimously ruled on May 10 to uphold Bannon’s conviction in the case.
During Thursday’s hearing, Bannon’s attorney, David Schoen, reacted emotionally to Nichols’ order.
“One of the things you have to learn as a lawyer is when a judge makes a decision, you don’t stand up and yell,” Nichols said, according to NBC News.
“I’ve had enough,” the judge said as Schon continued to speak.
The lawyer responded: “I didn’t yell.”
“You put someone in jail who thinks he’s following the law, and we don’t do that in our system,” said Schoen, who called Nichols’ ruling “a violation of our justice system.”
Nichols retorted: “I think you should sit down.”
“This decision is actually wrong in so many ways, it’s a terrible decision,” Schoen told reporters outside court.
He said Bannon’s appeal needs to be heard by the Supreme Court. Schoen argued that Bannon was not guilty of contempt because Bannon’s lawyers at the time advised him not to comply with the House subpoena.
“I have great lawyers and we will appeal all the way to the Supreme Court if necessary,” Bannon told reporters Thursday.
“Nothing can shut me up, nothing can shut me up,” he said. “No prison can shut me up”
As Bannon walked away, one protester yelled, “Lock them up!”
“You are a coup plotter!” the protesters shouted. “This is a failed coup!”
An order from the U.S. Court of Appeals for the District of Columbia Circuit or the U.S. Supreme Court could suspend Bannon’s prison sentence.
But legally, Bannon has little hope of winning a reprieve or having his conviction overturned in either court.
