New York’s Supreme Court on Tuesday rejected former President Donald Trump’s appeal of a gag order in his criminal hush money trial.
New York Court of Appeals in a brief decision Refuse to listen to Trump’s proposal “on the grounds that it does not directly involve substantive constitutional issues.”
The decision means Trump’s gag order, which prevents him from talking about jurors, witnesses and other parties in the Manhattan Supreme Court case, remains in effect.
Trump’s lawyers asked Judge Juan Merchant, who is presiding over the trial, to end the gag order now that the trial is over.
However, the Manhattan District Attorney’s Office urged Merchants to maintain the restrictions, at least until a sentencing hearing is held and certain post-trial motions are resolved.
The Trump campaign and the attorneys who filed the gag order appeal to the state Supreme Court did not immediately respond to CNBC’s request for comment. A spokesman for the Manhattan District Attorney declined to comment.
Trump was convicted last month of 34 felony counts of falsifying business records as part of a scheme to conceal hush-money payments to porn star Stormy Daniels.
The Republican presidential candidate will be sentenced on July 11, just four days before the Republican Party’s nominating convention.
In New York, the crime of falsifying business records carries a maximum penalty of four years in prison, but Merchin could spare Trump jail time.
